Sucesión a Titulo Universal y las Disposiciones Testamentarias / Succession on a Universal Basis and Testamentary Dispositions

Resumen

La presente investigación, tuvo como objetivo general analizar la situación jurídica de la sucesión a titulo universal frente a la disposición patrimonial realizada por el causante vía testamentaria y de este modo precisar el límite de la responsabilidad patrimonial, que se origina en la persona del heredero y del legatario y conforme a estos límites visualizar los posibles vacíos legales que dan paso a una potencial vulneración al tan fundamental principio de la seguridad jurídica. Los teóricos principales que sustentaron la investigación fueron: Esparza (1993), Sojo (1982), López (2009), entre otros. La investigación fue de tipo aplicada, con un alcance socio jurídico, de diseño documental, el método utilizado fue el análisis y síntesis de la investigación. Se concluyó que la falta de regulación en materia de disposiciones testamentaria le permite al testador manipular el principio de la voluntad póstuma con el objeto de evadir obligaciones y defraudar a sus acreedores.

Abstract

This investigation had as general objective to analyze the legal status of succession on a universal basis, against the property disposal made by the deceased through a will and like this, specify the limit of the property liability that originates in the person of the heir and the legatee, and according to these limits, visualize the possible legal gaps that lead to a potential violation of the fundamental principle of legal certainty. The main authors who supported the research were: Esparza (1993), Sojo (1982), Lopez (2009), among others. This research was based on an applied method, with a socio-legal scope, documentary design and using the analysis and synthesis. It was concluded that the lack of regulation regarding testamentary provisions allows the testator to manipulate the principle of posthumous will, in order to evade obligations and defraud its creditors.
